POCATELLO — A man who was allegedly driving erratically and drinking alcohol when he crashed into a Pocatello fire truck faces charges after his juvenile passenger suffered severe injuries.
Josue Cabrera Flores, 33, has been charged with felony injury to a child, court records show.
Pocatello police responded to reports of a crash near the intersection of Berryman and Pole Line Roads around 2:45 p.m. on April 16, according to an affidavit of probable cause.
Upon arrival, officers found a Pocatello Fire Department fire engine and a 2022 Kia Telluride SUV without plates. Both vehicles were heavily damaged.
The driver of the Kia, later identified as Flores, was found in possession of an open beer bottle, police reports show. His 11-year-old passenger was transported by ground ambulance to Portneuf Medical Center with two broken femurs and a broken arm. From PMC, the child was taken to Primary Children’s Hospital in Salt Lake City by Life Flight, the affidavit says.
Officers spoke with witnesses, who described Flores driving “at high rates of speed and “weaving through traffic.”
Flores allegedly told police he had a single beer before driving.
Flores was released from Bannock County Jail after posting a $25,000 bond Monday.
Though Flores has been charged with this crime, it does not necessarily mean he committed it. Everyone is presumed innocent until they are proven guilty.
If found guilty, Flores could face up to 10 years in prison and $50,000 in fines.
He is scheduled to appear in court before Magistrate Judge Carol Tippi Jarman for a preliminary hearing on May 15.
